Conditions of Use


General Terms and Conditions

1) Applicability

These general terms and conditions apply to the web shop of ComiQuest and cover all sales, deliveries and payments to our clients through the website www.comiquest.nl. By placing an order you explicitly agree with these terms and conditions.
We shall at all times retain the right to change or supplement these terms and conditions, provided that these changes are published on our website.
The website www.comiquest.nl and these general terms and conditions are subject to Dutch law. Any disputes will be settled in court and shall be subject to Dutch law.

 

2) Agreement/conditions

When you have placed your order and received an order confirmation e-mail from www.comiquest.nl you have legally entered into an agreement with ComiQuest.
ComiQuest shall retain the right to refuse online orders without reason given.
The products you have ordered shall remain the property of ComiQuest until you have paid the full invoice amount.
We shall do everything in our power to keep the website up-to-date. However, it is possible that certain products are temporarily unavailable. In that case we will contact you by e-mail as soon as possible.

 

3) Prices/Delivery

The prices stated on the website are inclusive of VAT (6% or 19%) and exclusive of shipping costs.
Shipping costs are always at the expense of the client and may vary per country. ComiQuest cannot be held liable for incorrectly stated prices, for example as a result of entry or printing errors. No rights can be derived from incorrect price information. Special offers are clearly indicated on the website. Offers remain valid as long as stock lasts.
ComiQuest aims to deliver your order within 5 working days after receipt of your payment. The legal delivery term is within 30 days after receipt of payment.
Deliveries in and outside Europe are carried out by parcel service TNT.

4) Force Majeure

ComiQuest cannot be held liable for force majeure circumstances. Force majeure circumstances are unpredicted circumstances, for instance fire, malfunctions, government provisions (for example import limitations) and logistical problems, which prevent us from meeting our obligations. In such circumstances any payments that have already been made shall be paid back as soon as possible. If we feel that the force majeure situation is only temporary we are allowed to postpone realization of the agreement until the force majeure situation no longer exists and we are able to carry out the delivery. In force majeure circumstances we cannot be held liable or held to pay any damages.

5) Payment

Payment can be carried out through the method indicated in the ordering process.
After you have placed and paid your order you will receive an e-mail stating your order number and the total sum of your order inclusive of shipping expenses.
Payment must always be carried out in full and in advance and in one of the following way:
By Bank transfer (NL/EU), cash if you decide to pick-up your order at the store or immediate online payment with a credit card by Paypal. We accept payment with Visa, MasterCard and American Express. All payments are handled securely by Paypal. Your financial details are always treated as confidential. ComiQuest does not have access to your credit card data; this information is only available to Paypal.

6) Returning your product

On our website we try to provide you with as much information about our products as possible. However, if a product does not live up to your expectations you can always return it to us within seven working days after receipt. Please state the reason why you wish to return the product to us. The term of approval shall take effect on the day your ordered product is delivered to the delivery address you stated in your order.
The costs for returning a product are always at the expense of the client.
The following conditions apply when returning a product:
a) Before returning your order, please fill in the return form completely and send it back with your return package
b) We only accept products that are returned in their original delivery condition, i.e. un-read, un-opened, sealed, unworn with original labels attached and in original packing;
c) Please include the packing list in your return package. Any returning costs are at your own expense. Make sure you send back the package fully prepaid. Incomplete or understamped return packages shall not be accepted by
ComiQuest and shall therefore not be paid back to you;
d) Discount products CANNOT be exchanged or returned. You are always informed of this when you purchase a discount product on our website;
e) if we feel that the returned product has decreased in value we are allowed to settle this loss of value with the sum to be paid back to you.
We only accept returned products that have been reported to us through our website in the manner described above and of which the instructions, which were provided when you reported your product on our website, have been followed. Returned products that have not been returned within the stated period of time shall not be accepted.
The sum of the returned products shall after deduction of shipping expenses and/or settlement of any loss in value be paid back to you as soon as possible but always within 30 days.

7) Complaints

We do everything in our power to deliver a perfect product to you. If you nonetheless find any faults or errors in your delivery, please send an e-mail to info@comiquest.nl . We shall contact you as soon as possible and try to solve the problem.
The costs of a returned product with regard to a complaint shall in first instance be at your own expense. These costs will be reimbursed if your complaint is considered a valid complaint. If your complaint is considered valid we will send you the right product without any shipping costs.
We can never be held to pay any compensation or settle any consequential loss as a result of the delivery of a defective product.

8) Personal Data Protection Act

ComiQuest treats all personal data as confidential. Privacy-sensitive information is never passed on to third parties and shall only be used for orders that you place on our website. If you do not wish to receive any mailings from us, please send us an e-mail at info@comiquest.nl .
The Personal Data Protection Act states that you can at all times change or rectify your personal data.
